GENERAL TERMS AND CONDITIONS FOR PARTICIPANTS OF Pitch Control

These are the General Terms and Conditions for participants of the Pitch Control organized by SC CUE PLAY SRL.

Article 1. Definitions

Pitch Control: a bi-annual DJ program that takes place with the purpose of offering support, mentorship and guidance to young DJs and music producers, organized by CUE PLAY SRL, consisting in a 5 days event, a platform for brand activation and registration.

Organizer: CUE PLAY SRL

Event: the event of Pitch Control is open to participants only hereby described as electronic music advanced DJs and producers, all in the broadest meaning possible, consisting in a 5 days experience created and implemented by the CUE PLAY SRL listed as the Organizer. 

Pitch Control Trademarks: the distinguishing signs of the Pitch Control such as names, house style, web design, colors, and logos, whether or not they have been registered as exclusive trademarks for products and services relating to the event, company and promotion of the Pitch Control in the broadest sense of the word, or otherwise legally protected;

Agreement: any agreement concluded or to be concluded, directly or indirectly, between the CUE PLAY SRL listed as the Organizer and the Participant in relation to the registration through Register Now;

Participant: a person who, as written in the online form, is reliable to register for the program, directly or indirectly concludes an Agreement with the Organizer, for the participation at the Pitch Control Program. These terms and conditions apply to the legal relationship between the Participant and the Organizer  with regard to the use of the Register Now tab and the participation at the program;

Event: a 5 days program which is open and available for participants only, the guests brought by the Organizer and partners, as mentioned on the official website, and which consists of various activities as listed by the Organizer. The event is taking place at a chosen location mentioned on the official website, where 4 guests in the field of electronic music deliver guidance and training.

General Terms and Conditions

Panels: sessions involving the mentioned guests and participants;

Accommodation: The Organizer has concluded an agreement with the venue for the purpose of offering a 4 days stay for the Participants and Guests during the Pitch Control program on the dates listed on the official Website; The first day of the event will take place in Bucharest.

Transportation: provided service by the Organizer, for Participants and Guests during the Pitch Control program, on a distance, agreed by the Organizer to have a starting point in Bucharest and the destination at the event location according to the event schedule provided by the Organizer;

Photographer/s: the person/s or business entity that is responsible for the photos and/or videos during the event’s period;

Venue: the place, including without limitation the relevant building, building complex or the room(s) where the various activities of the Pitch Control, such as those relating to the Panels are held; 

Sponsor: a business entity that has established a sponsorship contract with the Organizer, with the purpose of promotion and benefits in the Pitch Control program communication campaign;

Register Now: a registration landing page provided by or on behalf of the Organizer which provides the Participant an online form to fill in, in order to be a part of the Pitch Control event;

Ticket Price: the price for a Ticket, excluding any extra service and/or handling fees; the payment for a ticket will proceed when the Participant has received the final confirmation via phone call by the Organizer. The following payment will be done through a contract between the Participant and the Organizer; There is no subscription fee. There are only 10 tickets available and the amount will be transferred by wire, based on the invoice issued on the participant’s name.

Written request: a written request submitted to the CUE Play SRL, which can be sent by email to contact@pitch-control.net.

Article 2. Scope of Registration

2.1. These General Terms and Conditions apply to all offers and all the information provided by the Organizer through the official website and to all Agreements between the Organizer and the Participant. These General Terms and Conditions for participants also apply to accommodation and transport.

2.2 The same Agreements apply for each Participant when he or she enters the Venue. The General Terms and Conditions of the Pitch Control program are being applied between the Participant and the Venue itself.

2.3 We advise all participants to carefully read  the General Terms and Conditions for Participants before filling the online form.

2.4 SC CUE PLAY SRL may from time to time amend these General Terms and Conditions for the Participant. We advise you to read these General Terms and Conditions for Participants periodically to keep abreast of any changes that may be made during and after the official website has been launched.

Article 3. Offers and Agreements

3.1 Information, offers, communications and quotations relating to Ticket and event are provided by the Pitch Control and/or a third party as accurately as possible, by written ways, through website, Social Media platform or through the Register Now. The Pitch Control does not accept liability for any inaccurate or incomplete information provided by the Pitch Control and/or third parties as meant above.

3.2. Information about the prices and availability of Tickets is provided as can be seen on the website and modifications will be brought without any further notice. 

3.3 All registrations made through Register Now are subject to approval by the Pitch Control and the 4 guests.

3.4 After an registration is made, the participant receives an automatically generated email confirming the information of the registration. This email does not constitute an approval of the order but is only an acknowledgment of registration. The Agreement between the Participant and the Pitch Control is concluded after the selection and the payment. 

3.5 The Pitch Control reserves the right not to approve any registration, for example, if it fails to obtain permission for confirmation of the registration if, at the Pitch Control’s discretion, the participant acts contrary to these General Terms and Conditions, which includes the situation where the Pitch Control has doubts about the accuracy or validity of the data provided by the participant in placing the order.  

3.6 Registration period will begin at the time decided by the Pitch Control, conducted through an online form that will require specific data from the Participant. After the registration, the Participant will receive a confirmation email which is not liable for payment yet, but for registration only. The Participant should and will proceed with payment of the Register Now Ticket only, and only after the Organizer has confirmed orally, through telephone, that the Participant may proceed with Payment as mentioned in the Terms and Conditions, based on the invoice issued on his name.

Article 4. Privacy

4.1 The participant who intends to register through Register Now or Newsletter Sign-Up must provide specific personal data, such as the participant’s name, email address, the relevant city/town, country, telephone, portfolio, position, tracks, SoundCloud profile, Resident Advisor profile (optional), Facebook page (optional) and other requirements included in form that do not come to conflict with Privacy Statements or GDPR. The purpose of these requirements is primary to ensure on the basis of such data that the registration can actually be confirmed and that the Pitch Control and/or its affiliates are able to fulfill their obligations under the Agreement. In addition, specific data concerning Speakers are published for the benefit of the Participant in order to inform the latter of who will participate at Pitch Control and to make sure that the Speaker profit from their own participation at Pitch Control to the maximum extent possible.

4.2 The use of the personal data of the Participant is governed by the Privacy Statement of the Pitch Control, which is published and can be consulted on the Website. For privacy-related matters, the participant is always free to contact us in writing via the following e-mail address: contact@pitch-control.net.

4.3 By entering into the Agreement with the Pitch Control and/or asking for registration or newsletter sign-up, the Participant grants express permission for processing the personal data in accordance with the Privacy Statement of the Pitch Control. 

Article 6. Registration

6.1 The Participant can register for Pitch Control by accessing the Register Now when available. When applying for registration, the Participant’s data must be provided to the Pitch Control through Register Now. The required data will use only, and only with the purpose of selection for the vacant places available for the Pitch Control, accordingly to the Pitch Control team represented by delegates of CUE PLAY SRL and the Guests, as mentioned in the Contract Agreement conducted between CUE PLAY SRL and the Guests.

6.2 The selection process will be conducted as specified in the Terms and Conditions. Any modification and/or change made by the Organizer will be applied to the Terms and Conditions specific section and communicated toward the Participant through the official Website(s). The Pitch Control team represented by delegates of CUE PLAY SRL and the Guests will analyse the database of the Participants after and only after the registration period has come to an end, and under no circumstances are the delegates or the Guests allowed to use the Participant’s specific data for any other purpose rather than selection.

6.3 The Participant will access the Register Now and fill in a registration form, by providing the following specific data: participant’s name, email address, the relevant city/town, country, telephone, portfolio, position, tracks, SoundCloud profile, Resident Advisor profile (optional), Facebook page (optional) and other requirements included in form that do not come to conflict with Privacy Statements or GDPR. If the Pitch Control team represented by delegates of CUE PLAY SRL and/or the Guests will consider that the provided data is not relevant for the selection process and/or the provided data is by any form related to fake information or fraud, they will proceed with the elimination of the certain Participant from the selection process. If any Participant does not meet the terms or conditions mentioned in the Terms and Conditions on the official Website, as regarding the necessary data that he/she must provide and the age requirement, the Participant will be immediately excluded from the selection process.

6.4 If the participant has not reached the age of 18 years old yet, he/she will take part at the selection. However, he/she can proceed with the Sign-Up for Newsletter, only and only if his or her parents/carers must be aware of the Privacy Statement and, if applicable, agree to the content of this Privacy Statement before the participant is able to do so.

6.5. Upon registration, a confirmation email will be sent to one person. Once the confirmation email has been delivered, the Participant, he/she will enter the selection process. Before having a final confirmation regarding the participation at the event, the Pitch Control team alongside the Guests will conduct a selection process by checking all specific provided data and select 10 and only 10 participants.

6.6 The participant may discuss any other questions with an assistant of the Organizer service, which can be reached on business days, from 10 a.m. to 6 p.m., at telephone number +0212272861 or through contact@pitch-control.net.

Article 7. Venue Agreement

7.1 With respect to the services provided by the Venue in connection with the overnight hotel stays, a separate agreement is concluded between the Venue and the parties using the services. The Pitch Control is a party to that agreement.  

7.2 The Pitch Control is not liable for any direct or indirect damage or loss arising from acts or omissions by the Venue and/or the staff or third parties engaged by the Venue.  

Article 8. Cancellation or Relocation of the Event

8.1 CUE PLAY SRL titled as the Organizer is entitled to change the Pitch Control or parts thereof. Only if the Pitch Control cancels the a panel or an activity, or the event as a whole, will the Pitch Control, upon a written request to this effect, refund the original participant who bought theTicket Price of the even. The terms and conditions of the relevant Organizers apply to the purchase price of the Ticket. The original participant qualifies for a refund of the purchase price of the event Ticket, less the handling fee and service charges, only if the the fist 24 hours after the payment.

8.2 The Pitch Control and/or the Organizer is/are entitled to cancel or relocate an Event. It is the responsibility of the participant to verify whether an Event is to be or has been cancelled or is to be or has been relocated and, should this be the case, to find out about the new date or the new venue. If an event is cancelled or relocated, the Pitch Control will do its best to ensure that, as soon as it becomes aware thereof, either the Pitch Control or the Organizer will notify the participant of the foregoing. The Pitch Control cannot guarantee, however, that the participant receives such information before the start of the Event. The Pitch Control is not liable for any damage or loss in this respect. 

8.3 If the event is cancelled or relocated, the general terms and conditions of the relevant Organizer apply to a refund of the Ticket Price. The Pitch Control is not liable for any damage or loss relating to the cancellation, alteration or relocation of the event. 

Article 9. Limitation of Liability

9.1 The Pitch Control accepts no liability or any damage or loss caused by the cancellation, alteration or relocation of the Event, nor for any other damage or loss, for whatever reason, which directly or indirectly arises from acts or omissions by the Organizer, the Venue and/or the Participants, or persons engaged by or on behalf of these, or by third parties, during an Event or relating to the stay at the Venue, unless the damage or loss is due to intent or gross negligence. 

9.2 If the Pitch Control imputably fails to meet an obligation under the Agreement and/or these General Terms and Conditions for participants, the Pitch Control is liable only for direct loss or damage, and only if it is legally obliged to bear such liability. In such a case, the Pitch Control is liable only if the participant immediately notifies the Pitch Control in writing about the failure in performance, providing a reasonable time-limit to restore such failure, and if the Pitch Control continues to fail in the performance of this obligation even after that notice of default.  

Article 10. General

10.1 Without the prior permission of the Pitch Control, the participant is not permitted to record or engage others to record the Event in whatever form, on whatever (digital) media, including photographing, filming, or making sound and/or visual recordings of the Event.  

10.2 The Pitch Control reserves the right to make sound and/or visual recordings during the Event. The Participant, therefore, agrees to the following:

a. agrees to recordings and/or use of his/her name, voice, portrait and/or image by audio and video display, whether broadcast and recorded life or otherwise, or any other form of distribution including photos or other current and/or future media technologies; 

b. gives unconditional permission for the free use referred to under (a), indefinitely and worldwide;

c. will hold liable neither the Pitch Control nor the parties who make use of visual and/or audio materials with the permission of the Pitch Control, for commercial purposes or otherwise, for the use of such visual and/or audio material;

11.3 Without the prior written permission of the Pitch Control, the participant is not permitted to distribute or engage others to distribute his or her own promotional material, including samples, advertising and/or brochure material, during the event and at the Venue, to the extent permitted by law.
